Subhash Chandra insolvency: NCLT 5-member bench stays August 25 verdict, to hear case afresh

The dispute issues a reimbursement plan proposed by Zee Group founder Subhash Chandra in private insolvency proceedings initiated by Indiabulls Housing Finance Restricted below Part 95 of the Insolvency and Chapter Code (IBC).

Below the plan, Chandra proposed to pay ₹6.25 crore to collectors in opposition to admitted claims of ₹22,006.57 crore. One other ₹25 lakh was earmarked for insolvency course of prices.

The plan was initially thought of by an NCLT bench comprising Judicial Member Ashok Kumar Bhardwaj and Technical Member Reena Sinha Puri. The 2 members delivered differing opinions.

Bhardwaj favoured approving the plan solely in relation to collectors who had supported it. He proposed permitting dissenting collectors, together with banks and monetary establishments, to pursue impartial cures for recovering their money owed.

Puri rejected the plan after discovering severe defects within the course of adopted by the decision skilled.

The matter was then referred to a 3rd member, Judicial Member Nilesh Sharma, below Part 419(5) of the Firms Act, 2013.
