Ajeet Bharti invoked caste notions of purity, hierarchy; prima facie attracts SC/ST Act offence: Delhi court

Bharti was booked in a primary data report (FIR) registered on August 23 below the SC/ST Act, Part 67 of the IT Act and Sections 196(1)(c) and 351(3) of the Bharatiya Nyaya Sanhita.

The criticism was filed by Balakram Bauddh, Delhi State President of the Azad Samaj Social gathering (Kanshi Ram), over Bharti’s video titled “SB79: Reservation Hatao Andolan Nautanki & Extra | Saptahik Bakaiti”.

The criticism alleged that Bharti used caste-based and abusive language, made objectionable remarks about Nagina MP Chandrashekhar Azad and BR Ambedkar, used sexually degrading language towards ladies and issued threats.

In keeping with the FIR, Bharti was responding to a viewer who instructed that he get his sister married to Azad, after which caste-based reservation would finish.

Bharti allegedly mentioned that if the viewer had married his sister or mom into the “Dom” or “Chamar” caste, the comparability may maintain.

He additional mentioned that merely being “a Chamar and an MP” was not sufficient for marriage and that Azad would first must “make himself worthy” of marrying a “Savarna” lady.

Showing for Bharti, advocate Jai Anant Dehadrai argued that Sections 3(1)(r) and three(1)(s) weren’t prima facie attracted because the complainant was neither current nor personally insulted or intimidated, and no recognized SC/ST member was proven to have been insulted in public view.

He submitted that the remarks had been rhetorical and hypothetical and never a press release about any actual or recognized lady.

Dehadrai additional argued that the allegations may solely be assessed after contemplating the whole, unedited recording and its context, which couldn’t be presumed towards Bharti on the pre-arrest stage.
