Drivers move Bombay High Court against Marathi language rule, says livelihood of lakhs under threat

The plea by the cab drivers argues that the Marathi language rule violates their elementary rights beneath Articles 14 (proper to equality), 19 (freedom to hold on commerce and career) and 21 (proper to life) of the Structure and is extremely vires the Motor Automobiles Act, 1988, which doesn’t prescribe any language requirement for driving licences.

As per the plea,

“The father or mother Act (Motor Automobiles Act) confers no energy upon the State Authorities to prescribe working information of any language as a qualification for a driver, as a situation of a badge, or as a situation of a allow, and confers no energy to droop or revoke a badge on such a floor. The impugned notification manufactures a brand new disqualification and a brand new floor of suspension and revocation which the parliament by no means enacted.”

Lakhs of poor and migrant drivers face imminent suspension of badges and cancellation of permits, threatening their livelihoods if the rule is carried out, the plea states.
